TERMS OF SERVICE

Welcome to Start N’ Go’s E-Commerce Marketplace Platform. By using our website and services, you agree to the following. This is a summary of our full Terms of Service. The full version governs in the event of any conflict.

 

0. Definitions
  • Seller – A Dealer or Consignor listing a vehicle on the Platform.
  • Buyer – Any user who browses, inquires about, or purchases a vehicle on the Platform.
  • Sales Agent – An authorized Start N’ Go representative who facilitates and observes buyer-seller meetups.
  • Lead – Any inquiry or Buyer contact generated through the Platform.
  • Success Fee – The commission payable by a Seller to Start N’ Go upon a completed sale, as defined in the Seller Accreditation Agreement and the applicablli Fee Schedule.
  • Circumvention – Completing or attempting to complete a Platform-introduced transaction outside Start N’ Go’s authorized process, or without remitting thli applicable Success Fee.
  • Refinancing / Sangla OR-CR – A brokered cash loan where a vehicle owner uses their fully-paid vehicle as collateral, facilitated by Start N’ Go as broker.
1. Role of Start N’ Go

1.1. We act as a platform connecting Buyers and Sellers, and as a broker for vehicle refinancing services.

1.2. We are not the seller, dealer, lender, or insurer in any transaction.

 

2. User Responsibilities

2.1 Provide accurate and truthful information.

2.2 No fake listings, fraudulent inquiries, or abusive use of the Platform.

2.3 Buyers must inspect and verify vehicles on an “As Is, Where Is” basis, subject to applicable implied warranty protections under Philippine law.

2.4 Sellers must ensure they have legal ownership and valid documents (OR/CR free from encumbrances).

2.5 Buyers must pay the vehicle purchase price directly to the Seller’s verified bank account, as coordinated by Start N’ Go’s Transaction Coordinator. Payments to unauthorized persons are not recognized.

2.6 All transactions that originate from a connection made through the Platform must be completed through Start N’ Go’s authorized process. Buyers must not encourage or participate in any arrangement to transact privately with a Platform-introduced Seller. Circumvention by any User may result in permanent ban.

2.7 Sellers who are accredited on the Platform are additionally bound by the Seller Accreditation Agreement, which sets out commission remittance obligations, financial consequences for circumvention, the Fee Schedule, and all listing compliance requirements.

2.8 Tampering with or attempting to hack the Platform is strictly prohibited and may lead to legal action under Philippine law.

 
3. Data Privacy

3.1. By using the Platform, you consent to collection and processing of your data per our Privacy Policy and R.A. 10173.

3.2. Your data may be shared with Sellers, financing institutions, insurance providers, and competent authorities (including the AMLC) as required by law.

3.3. For Refinancing / Sangla OR-CR applications, your personal, financial, and vehicle data will be transmitted to an accredited financing partner solely for loan evaluation. Separate consent will be obtained before submission.

 

4. Limitations of Liability

4.1. We are not liable for: vehicle defects or misrepresentation by Sellers; financing disapproval or delays; or insurance denials or disputes.

4.2. Our liability, if any, is limited to service fees you directly paid to Start N’ Go.

 

5. Account Suspension and Permanent Ban

5.1. Accounts engaged in fraudulent, illegal, abusive, or circumvention activity may be suspended or permanently banned without refund.

5.2. Permanent bans are logged against the User’s government-issued ID number, business registration number (for Sellers), name, and vehicle plate number(s). A ban survives re-registration under any new account or identity.

 

6. Dispute Resolution

6.1. Governed by Philippine law.

6.2. All disputes follow the Start N’ Go Unified Dispute Resolution Procedure set out in the full Terms of Service §18, incorporated herein by reference. The sequential procedure is:

(1) Written complaint to [email protected]

(2) Good-faith negotiation (30 days)

(3) Proper courts of Quezon City (exclusive jurisdiction).

For claims within the Small Claims threshold, either party may use the Small Claims procedure (A.M. No. 08-8-7-SC). Start N’ Go may seek emergency injunctive relief from the courts of Quezon City without prior exhaustion of Steps 1 and 2.

 

7. Refinancing Services

7.1. Start N’ Go offers vehicle refinancing brokerage (Sangla OR-CR) as a separate service. Start N’ Go acts as broker only and does not extend loans. All credit decisions rest with the accredited financing partner. Full terms in the main Terms of Service §19.

 

8. Anti-Money Laundering

8.1. Start N’ Go complies with the Anti-Money Laundering Act (R.A. 9160, as amended). Users are required to cooperate with identity verification and KYC requirements. For high-value transactions (PHP 500,000 and above), enhanced due diligence may be required. Full terms in the main Terms of Service §20.

 

9. Agreement

9.1. You will be required to agree to these Terms, our Privacy Policy, and (for Sellers) the Seller Accreditation Agreement, by clicking “I Agree” during registration.

9.2. We may update these Terms at any time. Continued use of the Platform after posting of updates constitutes acceptance.
